सिरहाबाट गठबंधनका पाँचजना मधेशी अभियन्ता गिरफ्तार, राज्यको निरंकुशता विरुद्ध सामना गर्न तैयार रहन आग्रह

लहान, २०७२ साल पुस १८ गते। नेपाल प्रहरीले पुस १८ गते शनिबार सिरहाको कटहाबाट मधेश सम्बन्धी अन्तरक्रिया कार्यक्रम गर्ने क्रममा गठबंधनका पाँच जना मधेशी अभियन्तालाई गिरफ्तार गरेको छ। सो क्रममा प्रहरीले बिष्णु चौधरी, चन्देश्वर महतो, सुदिप कुशवाहा, संतोष महतो र रमेश महतोलाई गिरफ्तार गरेको हो।
मधेशी अभियन्ताहरुलाई विना कारण गिरफ्तार गरी निरुत्साहित गर्ने नेपाल सरकारको मनसायलाई समाप्त पार्न सबै जिल्लाका मधेशी अभियन्ता तथा कार्यकर्ताहरुलाई तैयार रहन समेत आह्वान गर्दछौं।
शांतिपूर्ण रुपले राजनैतिक अन्तरक्रिया कार्यक्रम गर्न खोज्दा समेत नेपाल प्रहरीद्वारा गरिएको यस गिरफ्तारीको गठबन्धन घोर-भर्त्सना गर्दै उनीहरुको अविलम्ब रिहाईको माग गर्दछौं। साथै सम्पूर्ण पत्रकार, मानवअधिकारकर्मी तथा अन्तर्राष्ट्रिय समुदायलाई नेपाल सरकारद्वारा गरिएको यस कुकृत्यको विरोधमा सशक्त आवाज उठाई दिनुहुन विनम्र अनुरोध गर्दछौं।

Nepal Police’s crackdown on Madheshi activists / On Human Rights Day, police arrests more than a dozen from Sarlahi for trying to hold an interaction program

On 10th December, Nepal Police have foiled a peaceful interaction program in Sarlahi district and have arrested more than a dozen of Madheshi activists, including Kailash Mahato, the sub-coordinator of the Alliance for Independent Madhesh, the chief guest for the program. The arrested people include senior members Dharma Lal Ray, Hridaya Narayan Chaudhari and Saroj Yadav. The police used force and threat to disperse the gathered mass of about three hundred people, and vandalised the program venue.

Similarly, on 7th December, Nepal Police arrested Roshan Sah, the proprietor of the Ashutosh Printing Press from the Patan Industrial Area in Kathmandu on the accusation of “printing pamphlets with Buddha Gandhi and Mandela on its cover and biography of Dr. C. K. Raut on its back.”[1] Police have filed a public offence charge against him. He is still under custody.

Likewise, among the four activists detained on 24th November, while they were holding a meeting in Bariyarpur of Bara district to commemorate November 26th as ‘the Racial Arrest Day’, through peaceful placard demonstrations, Brajesh Singh and Sadam Ansari have been sent to prison in Birgunj for pre-trial detention, with a clear motivation to torture them. Police have filed a fake charge against all of them, namely Brajesh Singh, Sadam Ansari, Binod Sarraf and Bitu Sah. On 24th November, before arresting them, the police had locked about 30 participants inside the meeting room inhumanly [2].

On 26th November, Nepal Police arrested more than a hundred activists of the Alliance for Independent Madhesh (AIM) led by Dr. C. K. Raut, from various districts, while they were demonstrating to mark the Sundhara Racial Arrest of 2014. The police arrested 31 activists from Kathmandu, protesting in front of the United Nations building to submit a memorandum, 34 from Siraha, 24 from Rauthat, 4 from Bara, and one from Parsa district [3]. The police used force in Biratnagar and Lahan, injuring about half a dozen of activists, and seizing loudspeakers and two bicycles. However, all of them were released later, after keeping three dozen of them for a night, subjecting them to mental torture using coercion and threats. The Alliance had decided to commemorate November 26th as ‘the Racial Arrest Day’, through peaceful placard demonstrations, to mark the arrest of more than 300 Madheshis one year ago on the same day, from the Sundhara area of Kathmandu, when the Nepal Police had arrested them just by looking at the colour of their skin (See, Amnesty International Appeal [4], Asian Human Rights Commission Report [5]).

Alliance for Independent Madhesh (AIM) condemns such undemocratic and cowardly acts of Nepal Police. Alliance for Independent Madhesh (AIM) is a coalition of Madheshi people, activists, political parties and various social organisations working for the independence of Madhesh, through non-violent and peaceful means following the principles of Buddha, Gandhi and Mandela. The alliance advocates an end to Nepali colonisation, racism, slavery and discrimination imposed on the Madheshis. It stands for three pillars: (a) Independent Madhesh (b) Democratic System, and (c) Peaceful and Non-violent Means.

Acknowledging that the rights to freedom of speech, movement, peaceful assembly and association are the fundamental rights of all human beings everywhere, as also mandated by the United Nations Universal Declaration of Human Rights (UDHR) and International Covenant on Civil and Political Rights (ICCPR), of which Nepal is a signatory, we expect acknowledgement and assurance of the rights to freedom of expression, movement and peaceful assembly from the state and its agencies. We hereby appeal to all human rights bodies, journalists and international communities to oppose any infringement on fundamental human rights by the Government of Nepal and its agencies, to secure immediate and unconditional release of the detainees, and to ensure fundamental human rights and freedom of expression for all.

झंडै एक महीनादेखि मधेश/तराईमा चलिरहेको आन्दोलनमा यहाँका जनता, नेता, कार्यकर्ता, पार्टी र मोर्चाहरू तथा विभिन्न सरोकारवाला समूहहरूले देखाएको प्रतिबद्धता र योगदान निकै नै सराहनीय छ। यस क्रममा शहादत प्राप्त गर्नुहुने सबैमा हाम्रो तर्फबाट उच्चतम सम्मान अर्पण गर्दै आन्दोलनको नेतृत्व गर्नु हुने तथा सहभागी भएर आन्दोलन सशक्त बनाउने सबैलाई हामी धन्यवाद पनि दिन चाहन्छौं।

आज हामी मधेश/तराईको ऐतिहासिक तथा निकै नै संवेदनशील मोडमा खड़ा छौं र हामी सबैले एकपटक गम्भीर भएर सोच्नैपर्छ। शांतिपूर्ण तरीकाले अधिकार माग्दा जुन तरीकाले नेपाली सेना र सशस्त्र प्रहरी लगाएर सिंगो मधेश/तराईलाई दमन गरिँदैछ, उचित मागलाई वेवास्ता गर्दै मधेश/तराईको जनताको नरसंहार र विस्थापित गर्ने अपरेशन चलाइदैछ, त्यसले ‘स्वतन्त्र मधेश/तराई’ बाहेक अरू कुनै पनि कुराले हाम्रो अस्तित्व बचाउन न सक्ने कुरा आम-जनतालाई समेत झन् छर्लंग भएको छ। जुन देशमा शांतिपूर्ण तरीकाले बोल्न समेत दिइरहेको छैन, सभा-सम्मेलन र बैठक समेत गर्न दिइरहेको छैन, र अधिकार माग्दा नेपाली सेना र सशस्त्र प्रहरी लगाएर गोली बर्साउने काम हुन्छ भने त्यो देशमा संघीयता आउँदैमा वा स्वायत्त मधेश/तराई प्रदेश बन्दैमा के फरक पर्छ ?

के प्रदेशहरू बने पछि, वा २२ बूँदे वा ८ बूँदे सम्झौता कार्यान्वयन हुँदैमा, यी अति नै महत्वपूर्ण तथा आधारभूत कुराहरू पूरा हुनेछन् ?

१. के नेपाली फिरंगी सेना मधेश/तराईबाट फर्केर जानेछन् ? र त्यसको ठाउँमा मधेश/तराईकै सेना हुनेछ ? होइन भने, मधेश/तराईमा जतिखेर पनि नेपाली सेना लगाएर हरेक संविधान, नियम, कानूनलाई खारिज गर्न सकिनेछ। मधेश/तराईमा नेपाली सेना रहेसम्म कुनै संविधान, नियम, कानून केहीले कुनै मायना नै राख्दैन, त्यसमा केही लेखाउनु-नलेखाउनुले कुनै अर्थ नै राख्दैन। त्यही भएर ‘आत्मनिर्णय सहितको स्वायत्त मधेश/तराई’को कुरा संविधानमा लेखाउने कुरा होस् कि साधारण शांतिपूर्ण रूपमा बोल्न र भेला हुन पाउने अधिकार — नेपालको संविधानमा केही लेखाउनाले मधेश/तराईको जनताको लागि फरक पर्दैन। किनकि सेना जसको हुन्छ, संविधान पनि उसकै हुन्छ। नेपालको संविधान सभामा मार्शल (सेना) लगाएर प्रकिया पूरा गरिनुदेखि लिएर अहिले नेपाली सेना परिचालित गरेर मधेश/तराईका जनताहरूको सबै अधिकार खोस्दै मुख समेत बन्द गरिनु यसको प्रत्यक्ष प्रमाण हो।

२. के मधेश/तराईको जनताको लागि अति नै महत्वपूर्ण नागरिकता नीति, विदेश नीति र सुरक्षा नीति मधेश/तराई प्रदेश कै हातमा हुनेछ ? होइन भने, जतिखेर पनि नेपाली शासकले मधेश/तराईको लाखौं जनताको नागरिकता समेत खारेज गर्न सक्नेछ, कसलाई नागरिकता दिने कसको खारिज गर्ने नेपाली शासकले आफ्नो मनोमानि गरिराख्नेछ, जतिखेर पनि खुला सीमाना बंद गर्न सक्छ, जति मन लाग्यो त्यति सेना र सशस्त्र कैम्प मधेश/तराईमा खड़ा गरी यहाँका जनतालाई दमन गर्न सक्छ।

३. के मधेश/तराईमा पहाडीहरू आएर बस्ने र कब्जा गर्ने क्रम रोकिनेछ ? नभए बिगत ५० वर्षमा मधेश/तराईमा पहाडीहरू ६% बाट बढेर ३३% भइसके भने अर्को २०-२५ वर्षमा के हुने हो ? यहाँका बांकी जिल्लाहरूको हालत पनि झापा, चितवन र कंचनपुर जस्तै हुनेछ, र मधेश/तराईका जनताहरू विस्थापित भएर शरणार्थी बन्न पुग्नेछन्, बचेकाहरू दास बन्न पुग्नेछन्।

४. मधेश/तराईको जागिर मधेश/तराईकै जनतालाई नै दिइने ग्यारेन्टी हुन्छ ? कुनै पनि हालतमा हुँदैन, किनकि पहाडबाट जुनसुकै ठाउँका मान्छे आएर मधेश/तराई को जागिर गर्न सक्नेछन्, सबै सिडिओ/एसपी, प्रशासक र कर्मचारीहरू पहाडी नै हुन सक्नेछन् र हुनेछन्। यहाँसम्म कि ओखलढुंगा वा जुम्लाका पहाडीहरू मधेश/तराई प्रदेशको मुख्यमंत्री बन्न सक्नेछन्।

५. मधेश/तराईको जल, जमीन, जंगल, खानी, राजस्व, वैदेशिक सहयोग लगायतका साधन-स्रोतमाथि मधेश/तराई प्रदेश कै नियन्त्रण हुनेछ ? यहाँ त प्रदेशहरूलाई एउटा जिल्ला विकास समिति जत्तिको पनि अधिकार न दिइने व्यवस्था हुन गइरहेको छ।

अहिले नै त नेपाली सेनाले संविधानबाट ‘लोकतान्त्रिक’ र ‘समावेशी’ शब्द हटाइ सक्यो, प्रहरी होस् कि अदालत कि लोकसेवा आयोग, प्रदेशलाई केही नदिने व्यवस्था हुँदैछ भने त्यस्तो प्रदेशहरूबाट के आशा गर्ने ?

आज यदि नेपाली शासक दुई-तिहाई बहुमतले संविधान बनाइरहेका छन् र त्यसलाई हामीले निकै बलिदानी दिएर आन्दोलन मार्फत् रोक्न आज सफल भए पनि, मधेश शांत भएपछि फेरि दुई-तिहाई बहुमतले संविधानका धाराहरू परिवर्तन गर्न नेपाली शासकलाई कति दिन लाग्ला? एक दिन पनि लाग्दैन। त्यसैले कति पटक हामीले महिनौं सम्म आन्दोलन गरिराख्ने र बलिदानी दिइराख्ने ? एउटा जाबो नागरिकताकै लागि १०० वर्ष अगाडि पनि बलिदानी दियौं, अहिले पनि त्यही नागरिकताको अधिकारको लागि बलिदानी दिइराखेका छौं, र यही बाटो रोजिराख्ने हो भने अर्को १०० वर्ष पछाडी पनि त्यही नेपाली नागरिकताको लागि मधेश/तराईका जनताहरूले बलिदानी दिनु पर्ने हुन्छ।भनेपछि त्यही दासताको बाटोमा सदियौं हिंडिराख्नु कतिको उचित छ ?

र आन्दोलन गरेर, बलिदानी दिएर अधिकार आखिर सुनिश्चित गर्ने कहाँ हो, लेखाउने कहाँ हो? त्यही नेपालको संविधानमा न हो ? तर नेपालको संविधानमा मधेश/तराईको जनता अनुकुल केही कुरा लेख्दै वा न लेख्दैमा के फरक पर्छ ? अहिले नेपालको संविधानमा धारा १३८ मा अधिकारसम्पन्न स्वायत्त प्रदेशको कुरा त लेखिएकै थियो, फेरि त्यही कुराको लागि किन बलिदानी दिनु परेको छ त, किन आन्दोलन गर्नु परेको छ त? त्यस्तै नेपालको संविधानमा मधेश/तराईका जनतालाई सेनामा न राख्ने वा नागरिकता न दिने भनेर त लेखेको छैन। तैपनि नेपाली सेनामा कति % मधेश/तराईका जनता छन्? तैपनि किन मधेश/तराईका दसौं लाख जनता नागरिकताविहिन छन् ? त्यसैले नेपालको संविधानमा केही लेखे पनि, न लेखे पनि मधेश/तराईको जनताको लागि केही फरक पर्दैन, त्यो नेपालको संविधान हो, मधेश/तराईको होइन।

स्वायत्त मधेश/तराई र समानुपातिक समावेशी कुनै आजको माग होइन, २००८ सालमा नै ‘तराई कांग्रेस’ले सशक्त रूपमा प्रमुख मागको रुपमा उठाएको थियो। अर्थात् विगत ६५ वर्षदेखि त्यही कुराको लागि मधेश/तराईका जनताले बलिदानी दिए, आन्दोलन गरे, तर के पाए ? नेपालमा मधेश/तराई गाभिएको २०० वर्ष भइसक्दा त यहाँका जनताले साधारण नागरिकताको अधिकार पाउन सकेका छैनन् भने नेपाली साम्राज्यबाट मधेश/तराईका जनताले अरू के नै पाउने आशा गर्न सक्छन्?
त्यही भएर नेपाली साम्राज्यबाट अधिकार पाउने नाममा अझ पर्खनु सर्वथा अनुचित र आत्मघाती हुनेछ, अझ पर्खनुले हाम्रो अस्तित्व नै मेटिने खतरा हुन्छ। ६५ वर्ष अगाडि स्वायत्त मधेश/तराईको माग उठदा मधेश/तराईमा केवल ६% मात्रै पहाडी थिए, तर अधिकारको नाममा पर्खदा-पर्खदा आज मधेश/तराईका आदिवासीहरूलाई विस्थापि गर्दै पहाडीहरू ३३% भन्दा बढी हुन पुगे। अधिकारको नाममा पर्खदा सीधै गोली हान्ने अधिकार सहित आंगन-आंगनमा नेपाल सशस्त्र प्रहरी पुगिसके, गाउँ-गाउँमा बन्दुक बोकर नेपाली सेना छिरिसके, भने अझै पर्खे के हुने हो ? अहिले नै दसौं हजारको संख्यामा झापा र कैलालीका आदिवासीहरू विस्थापित हुँदै शरणार्थी बनिरहेका छन्, भने अझै पर्खे मधेश/तराईमा कति मूलवासीहरू बांकी रहला र?

आज एउटा सीमांकन सच्चाउनका लागि त यति ठूलो आन्दोलन गर्नु परेको छ, यति धेरै बलिदानी दिनु परेको छ भने अन्य अधिकार पाउनका लागि कति चोटि आन्दोलन गरिराख्नु पर्ला ? र अघि नै भनि सकिएको छ, यदि आन्दोलनको राप पश्चात् संविधानमा अहिले सच्चाई हाले पनि पुन: जनता शान्त भएपछि त्यो कुरा दुई-तिहाईले फेरि उल्टाउन नेपाली शासकलाई एक दिन पनि लाग्नेछैन्। अनि त्यस्तो क्षणिक उपलब्धिका लागि मधेश/तराईका जनताले बारम्बार महिनौं आन्दोलन गरिराख्नु र मरिराख्नु कसरी उचित हो ?

आज हरेक गाउँ-गाउँमा, अधिकांश जुलुस र सभाहरूमा ‘स्वतन्त्र मधेश/तराई’ को नारा गुञ्जिनु जनता स्वयं ‘स्वतन्त्र मधेश/तराई’को पक्षमा रहेको भन्ने कुरा प्रष्ट हुन्छ, तर अहिलेसम्म नेतृत्ववर्गबाट नै जनताको त्यस आकांक्षालाई अन्यत्र मोडने काम भइरहेको हुँदा त्यसलाई सच्चयाई आन्दोलनलाई ‘स्वतन्त्र मधेश/तराई’ को गन्तव्यतिर डोर्‍याउनु हामी सबैको उत्तरदायित्व भएको कुरा यस्तो गम्भीर मोडमा हामी सबैले बुझ्नै पर्ने हुन्छ।

तसर्थ मधेश/तराईका जनतालाई अझै पनि कुनै हालतमा भ्रममा राखिनुहुन्न र मधेश/तराईमा आन्दोलनरत तथा सरोकारवाला समस्त पक्षहरू ‘स्वतन्त्र मधेश/तराई’को निर्णायक आन्दोलनको लागि संयुक्त रुपमा लाग्‍न ‘स्वतन्त्र मधेश गठबन्धन’ उनीहरूसँग विनम्र अपील गर्दछ। सोको लागि गठबन्धन हरेक किसिमले पहल गर्न र सहकार्य गर्न तैयार रहेको कुरा पनि समस्त जनतालाई साक्षी राखी अवगत गराउन चाहन्छ। आन्दोलनको शुरुवातको लागि मधेश/तराईका सभासद्हरूले औचित्यहीन नेपालको संविधानसभाबाट राजीनामा दिएर मधेश/तराईको नागरिक समाज समेत मिलाई ‘अन्तरिम मधेश/तराई संसद्’ गठन गरेर मधेश/तराई देशको स्वतन्त्रताको उद्‍घोष गर्दै अन्तर्राष्ट्रिय मान्यताका लागि अविलम्ब सार्वजनिक अपील गरिनुपर्छ भनेर हाम्रो मान्यता रहेको छ।

हम उन नेताओ से भी हार्दिक अपिल कर्ना चाह्ते है – जिनकी फटे चप्पलतक नही लगा पाने की औकात को मधेशानन्द जैसे वीर युवाओ ने बदल कर जेट मे सैर कर्ने, टाई-सुट लगाने,अरबो के मालिक बनने तथा अब्बल नेता कह्लाने का सौभाग्ज्ञ खडा कर दिया ।
मधेशानन्द जी भटके ही सही, मगर आज भी वे उन्ही नेताओ के सुन्दर भविष्य के साथ साथ सम्पूर्ण मधेश और मधेशियो के अधिकार के लिए लड रहे है जिसे वे नेतागण समझ नही पा रहे है । मधेशानन्द जी यही चाह्ते है कि मधेश मे मधेशी नेताअओ की नेतृत्व सबल एवम मजबूत रहे, मधेशी मतदाताओ को गैर-मधेशी नेता या समुदायो का मुह ताक्ना न पडे और इसिलिए को चाह्ते है कि कम से क मधेशी दल के सारे सम्बिधानसभा के सदस्य लोग वहाँ से राजिनामा देकर वापस मधेश आ आए ता कि मधेश के आन्दोलन को बल मिले, मधेशी लोगो मे उत्साह बढे और राज्य पर अन्तर्‍राष्टृय दवाब पडे और राज्य मधेशियो के साथ किए गए सम्झौतो को पालन कर मधेशिओ को अधिकार सम्पन्न बनाए ।
मगर हैरानी की बात यह भी है कि मधेशानन्द जी ने आजतक उन नेताओ को समझ पाने मे कही न कही कुछ न कुछ भूल तो नही रहे है ? क्यून्की उस आन्दोलन क एक छोटा सा टुक्रा मै भी था और मुझे हल्का फल्का समझ मे बात आ गयी और मैने उस नेतृत्व को छोडने का रिस्क उठा लिया ।
आप और आप के समस्त न्यायप्रेमी वीर मधेशी युवाओ से पूनह इस बात पर गम्भीर होने के लिए हमारा अनुरोध है कि क्या आपके सङ्हर्ष या बलिदानी को कोई स्थान मिलने बाला है ? क्या आपको यह नही लगता कि अभी मधेश नेपाली औपनिवेषिक राज्य के खिलाफ लडे तो आजादी जरूर पाएगी, क्यून्की सारा सन्सार मधेशियो का दुश्मन नेपाली राज्य को मानती है, मधेशी नेताअओ को नही । सन्सार यही समझती है कि मधेशी नेता सदन और सडक दोनो पर लड रहे है । और आप उसके खिलाफ लड रहे है- जिसने विज्ञापन ही निकाल दी है कि मरने बाले मधेशियो को पचास लाख रुपए दिए जाएङे तो समझिए आपके सहादत पर भी आपके परिवार को उतने पैसो का व्यवस्था कर दे । मगर मुझे तो वह भी नही लगता है, क्यून्की ०६३-६४के मधेशी सहीदो के परिवरो के साथ इन्होने अपना चरीत्र प्रदर्शन कर चुका है ।

In the past few months, the Nepal Police has made its presence conspicuous in the vicinity of the residence of Dr. CK Raut in Rajbiraj, Saptari District. The number of personnel ranges from 2 to well over a dozen, rising when they think Dr. Raut has reason to leave his home. They have placed Dr. Raut under 24-hour surveillance, and to do so, they have rented a house nearby and deployed some female members of the police there too. The police personnel have been doing their assigned job, however this is obstructing day-to-day life of Dr. Raut. Even his family members are living in fear due to constant surveillance.

The police have been intruding into the security and privacy of Dr. Raut’s family. They have been entering the house of Dr. Raut uninvited, anytime, grilling children, women, and senior members of his family, and searching his house without warrant.

One night last week, at around midnight, female police personnel, and possibly some policemen as well, climbed up on the roof of Dr. Raut’s house, using a neighboring property, to peek through windows into Dr. Raut’s room. It is not known to the Asian Human Rights Commission (AHRC) whether the police interlopers took photographs or recorded film of what they observed. However, what is known is that this act of clambering onto the roof at night to peek through the windows was repeated again this week as well.

The police also keep on circling Dr. Raut’s house on motorcycles at midnight, and past midnight, even up to 2 a.m. sometimes. This behavior of law enforcement is terrorizing the Dr. Raut family, including several senior members, women and children. They sleep in fear not knowing when the police will sneak about to peek through which windows, or intrude into the house from which direction.

Despite the Special Court having given him a clean chit on the treason charge filed against him on 8 October 2014, the police are denying Dr. Raut the most basic freedoms. He has been virtually placed under house arrest, forbidden to speaking to the public, hold a mass-assembly, or even make statements to the press. The last time he managed to come out of his house, somehow, was on June 24, to attend a meeting about foreign aid induced deforestation, migration, and resettlement projects in Madhes/Terai. And, even then, he was arrested at Lahan.

Prior to that, it was on May 26 that he managed to leave his house to be interviewed by Arena Television in Itahari, Sunsari District. On that occasion he was arrested from the interview room before the interview could be recorded, and kept in custody under cruel conditions. In the past, he has been arrested even when going to the hospital (on 2 April 2015), and prevented even from attending funeral rites (on 12 February 2015). The police have even broken his leg during a brutal attack on 3 January 2015 in Biratnagar. In another violent police crackdown on 4 April 2015, his head and arms suffered serious injury. The kind of torture he was forced to undergo in police custody, led him to undertake a fast-unto-death (from 21 September to 1 October 2014).

In addition, almost a hundred Madhesi activists have been injured in police suppression in the last few months; the police have filed more than a dozen fake public offence cases against the activists for supporting Dr. Raut. Dr. Raut’s supporters are being regularly harassed and tortured by the police.

Dr. Raut has also received dozens of serious death threats, even from government-registered organizations, which have officially issued death threats on their letterheads. However, the government has not taken any measures against those who have made these open threats.

The AHRC strongly urges the government of Nepal to respect Dr. Raut’s rights to freedom of speech, movement, peaceful assembly and association, which are fundamental rights of all human beings everywhere, as also mandated by the United Nations Universal Declaration of Human Rights, of which Nepal is a signatory.

Dr. Raut has been advocating for the constitutional right of secession in the upcoming Constitution and has been seeking an independent Madhes. This advocacy, however, does not justify the government of Nepal using intimidation, threat, harassment, fabricated cases, and violence to deny fundamental rights to Dr. Raut, his family, and his supporters.

The AHRC would like to draw the attention of concerned authorities, human-rights organisations, and civil society about the invasion of privacy and security of Dr. Raut and his family members by the Nepal Police. The Nepal Police must respect citizen’s privacy and security. The harassment of Dr. Raut and his family by the police must stop.

The government of Nepal will bear responsibility if anything happens to any of Dr. Raut’s family members from the intrusive activities of the Nepal Police, which include peeking through windows and entering the house uninvited at midnight.

Despite the Special Court has given him a clean cheat on a treason charge filed against him on October 8th last year, he has been virtually put into a house arrest, forbidding him from speaking to public, holding a mass-assembly, or even giving an interview. Last time he attempted to come out the house was on May 26th to give an interview to Arena Television in Itahari of Sunsari district, but he was arrested from the interview room, prior to giving the interview, and kept in custody under very torturous condition by Nepal Police. In the past, he was arrested even while going to the hospital (on April 2nd, 2015), and prevented even from attending funeral rites (on February 12th, 2015). The police had even broken his leg during a brutal suppression on January 3rd, 2015 in Biratnagar. He had to even undertake a fast-unto-death (from 2014 September 21 – 2014 October 1) against the torture given to him in the police custody.

In addition to that, almost a hundred activists have been injured in the police suppression in the last few months, and the police have filed more than a dozen of fake public offence case against Madheshi activists allegedly for supporting Dr. Raut. The supporters of Dr. Raut are regularly being harassed and tortured by police. Besides, despite Dr. Raut receiving dozens of serious death threats, which include government-registered organisations officially issuing death threats on their letterheads, the government has not taken any measures against them.

Notwithstanding such brutal physical suppression of the Madheshis by Nepal Police, Dr. Raut has instructed his supporters to stick to non-violence, and not to submit to police provocations. On 9th January 2015, he announced a ‘flower movement’ and asked all of his followers and well-wishers to hand-over roses to police, in retaliation to the force and violence they use.

Born in Saptari district of Nepal, Dr. Raut holds a PhD from Cambridge University and worked as a scientist in the USA prior to returning to Nepal to advocate for the rights of the Madheshis. He has been a recipient of a number of awards including Mahendra Vidyabhusan, Kulratna Goldmedal, Young Engineer Award and Trofimenkoff Academic Achievement Award. He has also authored ‘A History of Madhesh’, ‘Madhesh Swaraj (Self-rule)’ and ‘Denial to Defense (autobiography)’. He is also a director of the documentary, ‘Black Buddhas’, highlighting discrimination, racism and colonisation imposed on the Madheshis by the Nepali ruling class people. Just a couple of weeks before his first arrest on 13th September 2014, upon an official invitation from the Constituent Assembly of Nepal, he had attended a meeting of the Constitutional and Political Dialogue and Consensus Committee (CPDCC) in Singh Durbar, and suggested for the constitutional right of secession in the upcoming constitution. He has been advocating for independent Madhesh, through peaceful and non-violent means and is the central coordinator of the Alliance for Independent Madhesh (AIM).

Alliance for Independent Madhesh (AIM) is a coalition of Madheshi people, activists, political parties and various social organisations working for the independence of Madhesh, through non-violent and peaceful means following the principles of Buddha, Gandhi and Mandela. The alliance advocates an end to the Nepali colonisation, racism, slavery and discrimination imposed on the Madheshis. It stands for three pillars: (a) Independent Madhesh (b) Democratic System, and (c) Peaceful and Non-violent Means.

Acknowledging that the rights to freedom of speech, movement, peaceful assembly and association are the fundamental rights of all human beings everywhere, as also mandated by the United Nations Universal Declaration of Human Rights, of which Nepal is a signatory, we expect acknowledgement and assurance of our rights from the state and its agencies. We hereby appeal for assistance from all national and international organisations, human rights bodies and media to oppose any infringement on human rights by the Government of Nepal and its agencies and to secure immediate and unconditional release of the detainees. Until then, I ask you to assure the physical safety of detainees while in detention and guarantee that they are not subjected to torture or other ill-treatments.
